POWERS OF ATTORNEY
Making a Lasting Power of Attorney is one way of dealing with some of the practical problems commonly associated with old age but can also be made at any time. You can arrange for someone you trust (be it a family member, close friend, or professional) to have power to deal with may of the affairs that you may be unable to cope with or are not in a position to deal with. You can also appoint someone to make decisions as to your personal welfare. You can choose more than one attorney to act independently or together. You can put restrictions to limit the extent of the attorney’s powers. You can give guidance to your attorney(s). A Lasting Power of Attorney cannot be used until it has been registered at the Court of Protection. Either you or your attorney(s) can apply to do this. You can choose people to be notified in the event that an application is made to register the power of attorney, who can make representations to the court if they are unhappy about the proposed registration. We can advise you on Lasting Powers of Attorney and prepare them for you. We can also advise and assist with the registration process. Court of Protection Sometimes a person no longer has mental capacity to make a Lasting Power of Attorney. We can assist with the process of applying to the Court of Protection and dealing with the Office of the Public Guardian in an application to be appointed as deputy to deal with that person’s affairs.
